You may need to get an order to have it performed. There are so many questions that the body could tell, not least of which may be whether he was unconscious after the fall. If he was not, then why did he not stand up and walk out of the pool? If he was, then how is it that Michelle allegedly had a conversation with him before running into the house? Where were there abrasions on his body? If there were, then were they consistent with an accidental fall? Or were they consistent with being pushed? If there were no abrasions on the body, then why was he not able to walk out of the pool? You might also subpoena Michelle's computer that she was allegedly using at the time. Forensics can tell you a lot such as recent Google searches, etc. You might also subpoena her internet provider records as well as landline and mobile phone records. You might find out who she called the day of Stacey's death and immediately afterward. You might also consider a subpoena for the 911 records to see who, if anyone else, made the other 911 call. You should also get the 911 call made by Michelle. You should listen to it to learn her tone of voice and not just accept a transcript. There is a lot of evidence out there. You probably have to fight to get it. You might consider petitioning one of the more famous forensic scientists to perform an independent autopsy. I would be willing to bet money there was a lot missed. If an autopsy is being performed with the cause of death of drowning pretty much predetermined, then I'm sure the medical examiner wasn't looking for additional evidence, especially if law enforcement was telling him or her the "story of events" to be determined. You might consider not posting this email, as it could tip Michelle off to what you are pursuing. You might also consider asking for Michelle’s phone records in order to find out when she made calls to the insurance company or to the SBI. You will, of course, need to schedule a 30(b)(6) deposition of an insurance company representative to find out who at the Sheriff’s department communicated with the adjuster to release the insurance funds and what the communication consisted of. There may be a recorded statement to subpoena. You also want to find out who else from the Sheriff’s department communicated with the insurance company and whether the Sheriff himself was involved. You might want to send an engineer out to Michelle’s home to photograph the scene, especially around the pool in order to ascertain whether he could have slipped into the pool on his own property. How far is it from the pathway into the house? Would he have to have veered off his path into the house or is the pool that close that he could have fallen in on the way to the house?
